Copyright Lawyer

Everything You Need to Know about a Copyright Lawyer

Everything you may need to know about a copyright lawyer before you get one, there are so many different types of lawyers a little run down never hurt anyone. Copyright lawyers deal with many different subjects such as internet law, intellectual property, patent and trademark and of course your copyright laws. Each lawyer has gone to school for some time in order to get a degree to help you, which means they know more about the law than you do.

Some mistakes website owners make is when they buy articles online; many times a buyer just assumes they have full copyright. This isn’t always the case, depending what was agreed on will determine who has ownership. In order to make sure you don’t fall into this trap have a lawyer set up a contract before you hand over any money, this way you know for sure if you have full ownership or if the writer does.

There are actually three different categories that you may purchase an article, usage, full and unique. A copyright lawyer will explain exactly what each one means. Usage is basically meaning the buyer gets to use the article one time, but the writer can use it again or resell it. Full rights will give the buyer all rights; they can even place their name on the article saying they wrote it.

So far, we’ve uncovered some interesting facts about Copyright. You may decide that the following information is even more interesting.

A copyright lawyer will never tell you that you don’t have to register your copyright; in fact they will encourage you to do it. Sure, they get money to do it for you but you will have documented proof that you own the copyright. If you don’t file it, you can’t sue if someone uses your information.

A copyright lawyer is not cheap, that means if you are just looking to pay out a mere $300 you are looking in the wrong field. Sure there are sites that offer to do your bidding for you. Are you sure they are someone you trust? Stick with your gut feeling, pay the money and have someone there to walk you through everything you need. Most copyright lawyers will have special discounts on packages, which means you’ll be getting a lot more than what you originally walked in for. Chances are your lawyer will even advise you of things you didn’t even have knowledge about.

A copyright lawyer can help you better understand the laws of the virtual world, as well as the real world. Every day someone new is getting sued over content on the internet, it can be as simple as someone stealing an article, quote, song or a picture. A big issue is using another company’s name in your tags to get the search engines to rank you higher, you will get caught and when you do the fines are pretty steep.

Other issues may be with bloggers today, be careful with what you say about your places of business, not only could you get in trouble for any copyrighting issues but slander is another big issue.

Definition of Copyright Infringement

Protect Yourself: Know the Definition of Copyright Infringement

As you’re creating something, you may wonder what copyright infringement actually is. It’s necessary, if you’re creating a work â?? albeit written, musical, videos, software or some other form â?? that you know the definition of copyright infringement. This issue is very complicated, and not very easily spelled out in plain English, so please make sure that if you’re ever unsure to contact a copyright lawyer immediately to ensure you’re using copyrights in a legal method appropriate to the medium.

As I mentioned earlier, a definition of copyright infringement is difficult, at best. Copyright infringement is defined by the jurisdiction â?? the United States of America has different copyright laws than the United Kingdom, or Australia, or Russia, or even China. Because of this fact, you should first, before anything else, check the laws in your jurisdiction (country, city & province) before using something that isn’t in the public domain.

For our definition of copyright infringement, the public domain is a place where works are that aren’t copyright-able. Works that aren’t copyright-able include ideas, works that aren’t eligible (150 years-old documents, or older â?? think Beethoven and Frankenstein), data that isn’t categorized in a creative way (this could be a database, such as a phone book or other publicly-accessible data), or items that the owners have specified creative commons copyrights.

How can you put a limit on learning more? The next section may contain that one little bit of wisdom that changes everything.

As you can see, copyright law is rather complicated. Wikipedia.org gives us the definition of copyright infringement as: â??Copyright infringement (or copyright violation) is the unauthorized use of material that is protected by intellectual property rights law particularly the copyright in a manner that violates one of the original copyright owner’s exclusive rights, such as the right to reproduce or perform the copyrighted work, or to make derivative works that build upon it. The slang term bootleg (derived from the use of the shank of a boot for the purposes of smuggling) is often used to describe illicitly copied material.â?

Our definition of copyright infringement includes the works of creative commons. Creative commons is an organization that allows for the copyright author to determine the uses available for people who want to use their works â?? for such items as for audio, images, video, text, educational materials, and software. It allows for the copyright owner to allow people to use their works for non-commercial, commercial, no derivatives, share alike, or just by giving attribution. Creative Commons is a license granted by the copyright holder, and can be used in both online (electronic internet) works and offline works.

There are many places you can go to get a definition of copyright infringement. The most reliable definition of copyright infringement would be from your local copyright lawyer â?? they will know exactly what in your jurisdiction is legal or not, and how you can use other peoples’ works or protect your own.

While a legal country or organizational definition of copyright infringement is hard for the layperson to understand, a copyright lawyer will help you to figure out what it is that your work needs to be protected against copyright infringement, or to protect yourself if you intend to use the work of another writer, director, or musician.

Copyright Lawyer Trademark

Learning about a Copyright Lawyer Trademark

You may need a copyright lawyer trademark if you own your own website or are an author of a book. If you haven’t already spoke with one you may want to do it very soon to find out if your articles/site can be trademarked or if it is already taken. One way to make sure you have the copyright to all of your work is by making sure you have the little â??câ? inside the circle at the end of your article or the bottom of your webpage. For instance a slogan can be considered a trademark, think of the milk commercial, remember that certain phrase? You can bet money that had a copyright lawyer trademark it for the milk company.

Many products that may need protecting may include songs, products such as household or commercial, designs, ads, etc. If you think the idea is a good one, it probably needs some form of protection and the best person to help you with that is a copyright lawyer trademark.

If you find yourself confused by what you’ve read to this point, don’t despair. Everything should be crystal clear by the time you finish.

There are actually three forms of trademark that you probably weren’t aware of which is why a good copyright lawyer trademark will come in handy. There is common trademark which is just like it sounds. A state trademark, which means you, filed your trademark with the state in which you reside. An example for this might be a company using their city in their business name.

Third is the federal registration trademark, this is a registration that can be renewed every year or forever. Someone that has a website that is becoming popular may want to make sure they reserve their trademark forever so that someone else doesn’t buy it down the road. Keep in mind that just because you buy a domain name doesn’t mean you actually own the trademark, you might actually see another site with the same name. If you don’t want this to be the case, have a copyright lawyer trademark it. A great example of showing you how a copyright lawyer trademark works would be by looking at the recent celebrities that bought the trademarks to their children’s names so no one can cash in on their names.

Believe it or not even a copyright lawyer can have a trademark, that’s right they may have their own site or logo on a business card. In this case they’ve probably done all that fancy paperwork that you are getting started to do, which means they’ll have first hand knowledge when it comes time to help you out. This should actually make you feel a lot more comfortable than dealing with a lawyer that just knows the job; this one actually has experience that will help you. Know what you want to be yours and how long you want it; if it is something that you just can’t live without or you know will be worth something someday you may want to hire a copyright lawyer to trademark it.

This way it is always yours and you never have to worry about someone else using it, they will always have to have your permission. Not to mention if they ever try suing you for using it you can always prove that you are the owner. Protect your stuff by getting a copyright lawyer trademark all things that matter.

So now you know a little bit about Copyright. Even if you don’t know everything, you’ve done something worthwhile: you’ve expanded your knowledge.

Copyright Law Act

The only way to keep up with the latest about Copyright is to constantly stay on the lookout for new information. If you read everything you find about Copyright, it won’t take long for you to become an influential authority.

The Copyright Law Act of 1976

The Copyright Law Act of 1976 is the basis of the United States copyright laws. The Copyright Law Act states the rights of copyright owners, the doctrine of the fair use copyright laws and it changed the term life of copyrights. Before the Copyright Law Act the law had not been revised since 1909. It was necessary that the copyright laws be revised to take into account technological strides that were being made in radio, sound recordings, motions pictures and more. The Copyright Law Act of 1976 preempted all previous laws that were on the books in the United States, including the Copyright Act of 1909.

The Copyright Law Act of 1976 defines â??works of authorshipâ? to include all of the following:

- Musical works

- Literary works

- Dramatic works

- Pictorial, sculptural and graphics

- Motion Pictures and Audiovisuals

If you base what you do on inaccurate information, you might be unpleasantly surprised by the consequences. Make sure you get the whole Copyright story from informed sources.

- Sound Recordings

- Choreographic Works and Pantomimes

- An eighth work which falls under â??architectural worksâ? was later added in 1990.

What is unique about the United States copyright law is that it is automatic. Once someone has an idea and produces it in tangible form, the creator is the copyright holder and has the authority to enforce his exclusivity to it. In other words, the person is the owner of the creation. It is not necessary that a person register their work. However, it is recommended and it can serve as evidence if someone ever violates a copyright. It is interesting to note that when an employer hires an employee to produce a work that the copyright is given to the employer.

Violations of US Copyright Law are generally enforced in a civil court setting. However, there could also be criminal sanctions brought against someone who violates US copyright law. Someone that is in serious violation of US Copyright Law such as counterfeiting can find themselves on the inside of prison looking out. People need to understand that the copyright symbol is not a requirement. Someone may have a copyright, yet their work may not have a copyright notice or symbol.

US Copyright Law covers a wide range of things that are derived from artistic expression, intellectual or creative work. This includes things such as literary works, music, drawings, photographs, software, movies, choreographic works such as ballets and plays, poems, paintings and more. The law covers the form of expression, not the concept, facts or the actual idea of the work.

This means that someone can use another person’s idea or concept and produce their own take on it. However, copying another person’s work is a violation. It should be noted that some things may not be copyrighted but they may be protected by a patent or trademark.

Individuals who have a copyright on a particular piece of work can do with it what they will. They may choose to copy it and sell it. They may display their work or perform it in public and charge admission, or they can assign or sell the work to someone else. Individuals who have a copyright can also choose to do nothing with their work, if that is their desire.

However, if someone comes along and takes the work and tries to use it in some way, that person is still in violation of the owner’s copyright. The Copyright Law Act covers published and unpublished work.

Knowing enough about Copyright to make solid, informed choices cuts down on the fear factor. If you apply what you’ve just learned about Copyright, you should have nothing to worry about.

Copyright Lawyer Guild

What exactly is a copyright lawyer guild?

A copyright lawyer guild is just like any other guild, it a is club just for copyright lawyers. Many times you can find a list of names of all the copyright lawyers that have joined, as well as all their contact info and if they have a website or not. Sometimes you will have to be invited to join, while others it is free for you to look around.

However as a guest you may only be able to view certain information, once you pay though you’ll get to look at all the goodies the guild holds. There will most likely be a select amount of newsletters put out by the guild, the number depends on the guild itself and how many they want. In a way this is very much like a writer’s guild, you will have a list of every writer in a certain state and their information about them.

Any client can find a copyright lawyer’s guild online, this is basically a site that lists all types of information about copyrights, cases, lawyers, releases and much more. A client may even find out if the their copyright lawyer has been acknowledged for any special awards in the at-a-guy section, not all have this but most will. There will probably be a lot of articles on copyright issues and might explain to you what it is you need. You can also find cases that are currently going on and others that have already been through trial, this is a great way to stay up to date with all the latest copyrighting issue.

Most of this information comes straight from the Copyright pros. Careful reading to the end virtually guarantees that you’ll know what they know.

If you are lawyer it is great so you always know what is going on and what is being added to the laws that already exist. One may even find a forum inside an online copyright lawyer’s guild; this opens doors to both clients and lawyers. A lawyer may be able to find help in an area they aren’t 100% about and a client is able to ask for help without being charged.

A copyright lawyer guild may also be a group that meets every couple of months at a restaurant, office or a number of different places to discuss things. Topics may include things they are dealing with, cases in the press or inside the office, or hot topics in the field. How to help a client that is upset, how to use etiquette in emails, etc. They may watch a short film on copyrights and how they effect the business.

There may be a few seminars that they are invited too or asked to actually give speeches at, the topics are endless but will all reflect on their field of expertise. Guilds are a great way for a person to meet and greet others in their profession and share stories or experiences with one another.

Not all copyright lawyer guild list every lawyer, only those that pay for membership are. Which means if your lawyer hasn’t paid his dues than he won’t be listed, however this doesn’t make him a bad lawyer. Your lawyer may just be starting up and hasn’t got around to joining a guild or if he’s been around for a while maybe he hasn’t had much luck in finding clients through guilds and would rather do it the way he’s been doing it.

Copyright Law Plagiarism

Plagiarism Is Simply Unethical

Anyone who is a writer is concerned with plagiarism. Copyright Plagiarism Laws protects copyright holders from having their works plagiarized. Many people think it is ironic that the word plagiarism derives from â??kidnapperâ? in Latin. However, it is true. If a person uses another person’s words without permission, they have indeed stolen or kidnapped something that was owned by another and is in violation of copyright law.

Plagiarism is a very bad word in the writing world. Crediting the author of the work will not keep someone immune from being in violation of copyright law. Plagiarism is plagiarism, even if the author is cited if the author did not give permission for the work to be used.

One of the most common areas that copyright law plagiarism is violated is in the academic world. Many students will copy and paste the information they need for their research papers and essays straight off the Internet and turn it in to their professors. However, this type of cheating is easily detected now with special programs that professors can use. Plagiarism is unethical, not only in the writing world, but in the academic world, as well.

It seems like new information is discovered about something every day. And the topic of Copyright is no exception. Keep reading to get more fresh news about Copyright.

Did you know that you could plagiarism a work but not be in violation of the copyright? Likewise, you can be in violation of a copyright and not have been plagiarizing. It is really not that hard to understand. Let’s say you are using Abraham Lincoln’s exact words in a paper and you did not cite him as the source or give him credit. Well, Lincoln’s words aren’t copyrighted because they are in the public domain. But, you did plagiarize because you tried to pass off his words as your own.

Alternatively, if you use a picture in a book and you did not gain permission to use the book, you have violated copyright law because you did not source the artist and you did not get permission from the artist to use the picture.

If you are in school, the best way you can get around committing plagiarism is to simply list your sources. If you use someone’s word, list it in an endnote or in a footnote. List the resource you found it in the bibliography. Another way around copyright law plagiarism violations is to take notes when you are reading. Take notes in your own words and put the resource away. Write your paper from your own words.

No one wants to be singled out for plagiarism, especially a student who is concerned about their reputation at school and writers who need to keep their credibility in good standing. With today’s technological advances, it is not too hard to pinpoint plagiarized work. Even webmasters who run websites are on to the plagiarism crowd. They can run their entire sites through a special program to see if their content has been stolen and duplicated elsewhere on the Internet.

Don’t limit yourself by refusing to learn the details about Copyright. The more you know, the easier it will be to focus on what’s important.

Education Copyright Law

You should be able to find several indispensable facts about Copyright in the following paragraphs. If there’s at least one fact you didn’t know before, imagine the difference it might make.

The Nuts and Bolts of Education Copyright Law

It is a wonderful thing that Education Copyright Law is available for educators. It isn’t only teachers that can take advantage of education copyright law. Students are also covered under education copyright law — to a degree. Teachers are able to use copyrighted materials in their classroom and make copies of them. Students are also able to use copyrighted materials in school projects. The key to education copyright law is how often a teacher or student uses copyrighted material, in what way they are using it and how many copies they have of it. It is important that teachers and students do not cross the line of education copyright law or they could be in for some stiff penalties.

It helps many students and teachers to learn what exactly is not copyrighted. Any work that is in the public domain is not copyrighted and can be used in school and for school projects. Work that is not in the public domain is copyrighted and if you use it you should make sure you fall within the fair use or education copyright law regulations.

Many people do not know what exactly fair use copyright regulations are. When you are trying to see if you can use another’s words, you should keep a few things in mind. The answer to the following questions will help you gage whether you would be violating a copyright. First, are you transforming someone else’s work or are you copying it directly? If you are using another person’s work directly, for what purpose and how much of the original author’s work are you using?

If your Copyright facts are out-of-date, how will that affect your actions and decisions? Make certain you don’t let important Copyright information slip by you.

Many publishing companies have set rules on how much material they will allow to be quoted in other sources. Some of these ranges start at 100 words or less. However, there are truly no standards to go by, so be careful. You can not assume that keeping your copying fewer than 50 words will allow you to pass under the radar â?? especially if the original piece is hovering around 125 words itself! There is a greater amount of room to maneuver when it comes to technical writing.

For instance, if you are writing a report on something that involves a lot of reporting from an expert, you would probably need to quote more of their work than you would a fiction novelist’s work. The fair use copyright law enables people to use portions of material that is copyrighted for the purposes of criticism or as commentary.

Individuals who are involved in the distance education field should take a look at the TEACH Act that was made into law in 2002. This Act clearly outlines the requirements that a university or school must be in compliance with when it comes to transmitting copyrighted works via the Internet.

The TEACH Act allows students and teachers to transmit copyrighted works, but they must be within certain guidelines. If the school or university cannot meet these guidelines, the material that is being transmitted via the Internet needs to fall within the fair use copyright act â?? or the individuals involved need to have permission from the copyright owner.

If you are an educator and you are using copyrighted material make sure it falls within the education copyright law.

Software Copyright Statement

A Software Copyright Statement Protects Current and Future Works

If you have a site that is dedicated to the sharing and distribution of open source software it is a great idea to have a software copyright statement that explains the limits of use for your software as well as the limits of your responsibility for those uses. I also recommend getting an attorney to look over the statement before posting it just to be sure there are no legal issues that you may be unaware of.

A software copyright statement doesn’t have to be a 10 page booklet on the law or the protections that copyright offers, it should be a simple short paragraph stating the basics and hopefully covering your rear from litigation and/or responsibility should someone use the software you are allowing them to use for something insanely stupid or frighteningly criminal while establishing your ownership of the material and expectations of those you are allowing to use your creation.

This for some is a no brainer because they’ve done it before and know the ropes. There are new software developers born and made each and every day and this type of software copyright statement may serve to save them a little grief of their own some day. If you are being kind enough to freely share the software you created with others, you’d like to think that they would at least return the favor of using it within the letter of the law or the manner in which it was intended. This, however, is rarely the case so protecting yourself, your copyright, and your future interests by posting a software copyright statement on your website is really the best way to go in a situation such as this.

Think about what you’ve read so far. Does it reinforce what you already know about Copyright? Or was there something completely new? What about the remaining paragraphs?

Trust me I’m not trying to talk anyone out of sharing his or her software with the world. I rather like open source software and admit to using it freely (no pun intended). I love saving money almost as much as I love playing around with new technology. Software allows me to do that and find likes and dislikes about all kinds of programs. Issuing a software copyright statement is one way of protecting your investment of time, effort, energy, and sheer brilliance in the making and design of your technological masterpiece. Hopefully that flattery will keep you going a bit longer at any rate.

It is important to know that a software copyright statement is only part of the process required to protect your software but for the most part poses a significant deterrent to those that would abuse your copyright and/or your kindness in allowing the distribution of your software.

Even if you are charging people for the use of your software (we are a nation of capitalists after all) you still need to protect the labor you have put into making not only the software but the distribution method, the website, the payment method and the thousands of other things that are part and parcel of the business model for your software distribution. Your software copyright statement is a very small protection for your software don’t expect it to be the brunt of your protection.

By protecting all your work with a software copyright statement you are not only protecting current works but future works as well.

So now you know a little bit about Copyright. Even if you don’t know everything, you’ve done something worthwhile: you’ve expanded your knowledge.

Fair Use Copyright Law

This interesting article addresses some of the key issues regarding Copyright. A careful reading of this material could make a big difference in how you think about Copyright.

Don’t Overstep the Fair Use Copyright Law

Many people are interested in the fair use copyright law. The fair use copyright law enables people to use portions of material that is copyrighted for the purposes of criticism or as commentary. The hard part for many people is understanding what is permissible under the fair use copyright law and what is not permissible. Anyone who writes or publishes should brush up on what is allowed and what is not allowed. Using another person’s words to make news reports, to use as a comment or criticism or to use for research, scholarship, or for educational uses that are nonprofit are generally considered fair use.

In these instances, the fair use copyright law allows one person or author to make use of another person or author’s work without asking permission to do so. In situations that do not fall within these specifications you are probably violating someone’s copyright if you use their work â?? especially if you are using another person’s work for economic or commercial gain.

When you are trying to see if you can use another’s words, you should keep a few things in mind. The answer to the following questions will help you gage whether you would be violating a copyright. First, are you transforming someone else’s work or are you copying it? Second, are you going to be making any financial gains from your work that would compete with the original copyright holder? Third, do you have the author’s permission to quote their work?

Truthfully, the only difference between you and Copyright experts is time. If you’ll invest a little more time in reading, you’ll be that much nearer to expert status when it comes to Copyright.

Just because you list the author and give credit to him or her does not protect you from infringing upon someone’s copyright. Fourth, how much of the original author’s work are you using? If you are using a substantial amount of another’s work, you are probably in direct violation of their copyright.

Lastly, what portion of another’s work are you using? If it is the meat of the book and the most important part of the book, you are probably in direct violation of the owner’s copyright.

With a little common sense it is not hard to decide if you are violating someone’s copyright. People who are truly interested in staying within the guidelines of the fair use copyright law usually do a good job of doing so. Many people push the fair use copyright law right up to the line, while others will blatantly cross over it without giving a second thought to the repercussions. When these people are summoned to court to answer for their vagrant disregard for the property and copyright of another they are usually sorry.

Sorry they got caught! It is very important that people who take advantage of the fair use copyright law are held accountable for their actions. Without accountability many more people would follow in their footsteps and use another’s works as their own.

Free Copyright Music

In today’s world, it seems that almost any topic is open for debate. While I was gathering facts for this article, I was quite surprised to find some of the issues I thought were settled are actually still being openly discussed.

Free Copyright Music Means Deeper Well for Artist Inspiration

Free copyright music is often mistaken with domain free music or music in which the copyright has expired. A copyright is in place for the lifetime of the author plus 70 years. If there are more than one writer’s for the music, the copyright will be in effect for 70 years after the death of the last surviving contributor.

While this rule was set in place in order to ensure that the heirs of the author would also benefit from the royalties after the music’s writer or composer was no longer living it is important to remember that these laws are the current laws and music written at different points in time are most likely subject to different copyright laws. When searching for free copyright music it is always a good idea to search through music that is very old rather than focusing your search on more recent musical selections as they will most likely still be under copyright protection.

It is important to remember when using free copyright music or public domain music that you must be certain the copy you are using is within the copyright period. Any music that was published before 1922 is public domain music. This does not however include derivatives or new versions of that music which may still be under copyright protection. Finding a copy of the music with the copyright date included, if that date is prior to 1922 is the best route to ensure that you are in compliance with current copyright laws and not infringing on someone else’s copyright.

Most of this information comes straight from the Copyright pros. Careful reading to the end virtually guarantees that you’ll know what they know.

It is also important to keep in mind that written music is protected differently than recorded music. Almost every sound recording that has been copyrighted in the United States is protected until 2067. If you absolutely need a sound recording you should either purchase one or make one of your own. There are some free copyright music that will allow free use of the music whether written or recorded, you must be thorough in your search for this music however as it quite rare.

Another thing to consider is that copyright laws in the United States are different than they are in other countries and if you wish to use music that is or was under copyright in another country you must follow the laws that apply to the particular piece of music you wish to perform. Free copyright music is available in almost every country and many genres; the trick is in finding great sources where you can easily find this music.

There is a project called Mutopia, which operates like project Gutenberg. Mutopia provides free copyright music rather than books however. The Gutenberg project also has a section that is devoted to free sheet music in addition to its wonderful resources for books. Each of these projects provides excellent resources for those who find themselves in need of free copyright music for whatever reason.

Whether you are a musician who is seeking inspiration from the music of old or hoping to find a composition, which you can rearrange and make your own, there are many ways in which you can go about achieving your goals that will not violate current copyrights. The key is in learning the laws both where you live and in any countries in which the music you seek to modify.

Take time to consider the points presented above. What you learn may help you overcome your hesitation to take action.
